PAIA Manual

The manual section 51 of PAIA requires every private body to publish: what records we hold, how to request one, what it costs, and what we may refuse.

This manual is published by Bonang M Investments (Pty) Ltd, trading as BOAN, in terms of section 51 of the Promotion of Access to Information Act 2 of 2000, which we refer to as PAIA. It explains what records the company holds and how a person may request access to them.

PAIA gives effect to the constitutional right of access to information. A requester does not have to give a reason for wanting a record held by a private body, but must show that the record is required for the exercise or protection of a right.

This manual is available free of charge on our website, at our offices during business hours, and from the Information Regulator.

1Particulars of the private body

2The Information Regulator's guide

2.1Section 10 of PAIA requires the Information Regulator to publish a guide on how to use the Act. It is available in each official language from the Regulator.

2.3We will assist a requester who needs help to formulate a request, and will do so in a manner that takes account of any disability.

3Records available without a request

3.1The following are published on our website and may be obtained without a PAIA request: this manual, our Privacy Policy, our Cookie Policy, our Website Terms of Use, our Terms and Conditions of Sale, our Delivery Policy, our Returns, Refunds and Cancellations Policy, and our Billing and Payment Terms.
3.2No notice has been published under section 52(2) of PAIA in respect of any category of record held by the company.

4Categories of record held

4.1Company records. Certificate of incorporation, memorandum of incorporation, share register, minutes and resolutions of directors, and statutory registers held under the Companies Act 71 of 2008.
4.2Financial records. Ledgers, invoices, statements, receipts, bank statements, annual financial statements and returns held under the Companies Act, the Income Tax Act 58 of 1962 and the Tax Administration Act 28 of 2011.
4.3Client records. Agreements, statements of work, briefs, quotations, correspondence, project files, artwork and deliverables.
4.4Supplier records. Agreements, purchase orders, invoices and correspondence with printers, manufacturers, freelancers and other suppliers.
4.5Employment records. Contracts of employment, personnel files, payroll records, leave records and records held under the Basic Conditions of Employment Act 75 of 1997, the Labour Relations Act 66 of 1995, the Employment Equity Act 55 of 1998 and the Skills Development Act 97 of 1998.
4.6Customer records. Store orders, delivery records, returns and account details held under the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002.
4.7Information technology records. System, hosting and backup records, and access logs.
4.8The fact that a record falls into a category listed above does not mean that access to it will be granted. Every request is considered against the grounds of refusal in Chapter 4 of Part 3 of PAIA.

5How to make a request

5.1A request must be made on Form C prescribed under PAIA, which is available from our information officer and from the Information Regulator's website.
5.2The form must be sent to the information officer at the address in clause 1.
5.3The request must provide sufficient particulars to enable us to identify the record and the requester, must state the form of access required, and must state an address or email address in the Republic.
5.4The requester must identify the right that is being exercised or protected and explain why the record is required to exercise or protect it. A request that does not do so will be refused.
5.5Where a request is made on behalf of another person, proof of the capacity in which the requester is acting must be attached to the satisfaction of the information officer.

6How a request is decided

6.1We will decide a request within thirty (30) days of receiving it and will notify the requester in writing of the decision.
6.2That period may be extended by a further thirty (30) days where the request is for a large number of records or requires a search through records held elsewhere. The requester will be notified of any extension and of the reasons for it.
6.3Where access is refused, the notice will state the reasons, the provision of PAIA relied on, and that the requester may lodge a complaint with the Information Regulator or apply to a court.
6.4Where a record contains information about a third party, that party will be notified and given the opportunity to make representations before a decision is taken.

7Grounds on which access may be refused

7.1Access must or may be refused where PAIA requires or permits it, including to protect: the privacy of a third party who is a natural person; the commercial information of a third party or of the company, including trade secrets and information that would harm its commercial or financial interests; information held in confidence, where disclosure would breach a duty of confidence; the safety of a person or of property; records privileged from production in legal proceedings; and records relating to research whose disclosure would expose the researcher or the subject matter to serious disadvantage.
7.2A record may also be refused where the request is manifestly frivolous or vexatious, or where the work involved in processing it would substantially and unreasonably divert our resources.
7.3Where a record cannot be found or does not exist, we will notify the requester by affidavit or affirmation to that effect.
7.4Where part of a record may be refused, access will be given to the remainder of it if it can reasonably be severed.

8Fees

8.1Two fees may apply: a request fee, payable before the request is processed, and an access fee, payable before the record is released. Both are prescribed by regulation under PAIA and are amended from time to time.
8.2The prescribed request fee is payable by every requester other than a personal requester, being a person requesting a record about themselves.
8.3The access fee covers the cost of reproduction, search and preparation, and postage. Where preparation exceeds six hours, a deposit of one third of the access fee is payable in advance.
8.4The current prescribed amounts are available from the information officer on request, and will be quoted in writing before any work is done.
8.5A requester may lodge a complaint with the Information Regulator against a fee that is considered excessive.

9Requests about your own personal information

9.1A request for access to personal information the company holds about the requester is made under PAIA using Form 2 prescribed under POPIA, and is dealt with under this manual.
9.2A request to correct or delete personal information is made on Form 2 prescribed under POPIA and is dealt with in our Privacy Policy.
9.3No fee is payable by a data subject requesting confirmation of whether we hold personal information about them.

10If you are unhappy with the outcome

10.1A requester who is dissatisfied with a decision may lodge a complaint with the Information Regulator in terms of section 77A of PAIA, within one hundred and eighty (180) days of the decision.
10.2A requester may also apply to a court for appropriate relief in terms of section 78 of PAIA.

11Availability and updates

11.1This manual is reviewed annually and whenever the company's records or particulars change materially.
11.2It is available free of charge on our website, at our offices during business hours, and from the Information Regulator. A copy in another official language will be provided on request where reasonably practicable.
